VILLA / APARTMENT RENTAL CONDITIONS AND AGREEMENT
PARTIES AND PURPOSE
This agreement is an initial agreement between the “VILLA/APARTMENT” renter (hereinafter referred to as “CUSTOMER”) and the “VILLA/APARTMENT” renter (hereinafter referred to as “VILLA KILUZU”). and ending dates are made for the purpose of renting a “VILLA/APARTMENT” for a certain period of time in advance. “www.villakilavuzu.com” The customer and their companions who make a reservation for any of our “Villas/Apartments” announced on the internet page through our internet page or by phone or e-mail are deemed to have accepted the following terms and conditions in advance. Any behavior contrary to the following terms and conditions, “VILLA KILAVUZU” gives the right to unilaterally cancel the reservation, request the customer to leave the Villa/Apartment, not to return the deposit, security deposit and rental fee received and to demand the full amount of the unpaid rental fee.
RESERVATION AND PAYMENT
You can make a pre-reservation for our Villas/Apartments using the reservation form on our website or via SMS, phone or e-mail. VİLLA KILAVUZU performs the pre-rental process by obtaining the necessary transportation and invoice information from you after you specify the dates of your rental for the Villa/Apartment you want to rent. VİLLA KILAVUZU takes 30% of the total fee to be paid for the villa/apartment after the pre-rental is made as a deposit. If the deposit is paid within 1 (one) business day after the pre-rental is made, the villa/apartment will be reserved in your name. The deposit amount you need to pay and our bank account numbers will also be notified to you via e-mail, SMS or phone. The deposit must be paid within 1 (one) business day by Money Order, EFT or again via the site by Credit Card. The latest 1 business day after the deposit is received A written confirmation of the rental of the Villa/Apartment will be sent to you within . This confirmation document states the total fee, the deposit received, the dates on which the Villa/Apartment was rented in your name and the day and time of the deposit you paid. If the deposit is not paid, VILLA KILAVUZU may use its right to cancel the pre-booking and make another reservation for the villa/apartment without informing the customer.
The remaining fee of the Villa/Apartment is officially collected from the bank after the contract is made or upon delivery of the Villa/Apartment (on the day of entering the Villa/Apartment) on the condition that it is deposited into the bank account of the villa/apartment owner.
WHEN THE CUSTOMER APPROVES THIS AGREEMENT, THE REMAINING FEE OF THE VILLA/APARTMENT RENT IS PAID BY THE FAMILY HE UNDERTAKES TO PAY THE DEPOSIT TO THE OWNER THROUGH THE BANK.
Again, VİLLA KILAVUZU, since the rented property is delivered to the customer as furnished, takes a damage deposit of 500 TL / 10,000 TL in case the items are broken, broken, damaged, lost, etc. and this deposit is taken in advance (in cash) against the receipt upon delivery of the Villa/Apart. The damage deposit will be returned to the customer if there are no deficiencies after the inventory of the fixed assets upon the customer's departure.
ENTRY AND EXIT OF VILLA/APARTMENT
The earliest entry time for the reservation day is 16:00, the latest is 21:00. The customer cannot enter the villa/apartment outside the specified hours, and if they arrive after the latest entry time, they can enter the villa/apartment the next day in the morning at the start of VILLA KILAVUZU's working hours (09:00). If the customer arrives before or after the specified time, VILLA KILAVUZU cannot be held responsible for any problems arising from not being able to enter the villa/apartment, staying overnight, not being able to find accommodation, etc. The customer must find their own place to spend the night and pay for their own accommodation. VILLA KILAVUZU cannot be held responsible for such situations. At the end of the reservation, the departure time from the villa/apartment is 10:00 in the morning at the latest for all our regions. The customer is personally responsible for all problems, damages, grievances, etc. arising from the customer not vacating the villa/apartment at all or vacating it late at 10:00 in the morning and will cover all material losses of VILLA KILAVUZU that may arise from these negativities. We would like to remind you that travel plans should be made according to these hours in order not to cause any inconvenience to either party. In case of an early check-out, VILLA KILAVUZU must be informed 24 hours in advance. In case the customer checks out of the villa/apartment before the villa/apartment can be checked due to density, the damage deposit will be transferred to a bank account provided by the customer and the shipping costs will be paid from the damage deposit. If the customer leaves the villa/apartment early of their own volition, no refund will be made to the customer for the accommodation fee.
VILLA/APARTMENT CAPACITY
The Villas/Apartments you select from the advertisements on our website will not accept guests exceeding the capacity stated on the advertisement page or the number of people stated when making the reservation (including children and babies). If the customer wishes to make a change in the number of people after the reservation is finalized, a written application will be made to VILLA KILAVUZU and this change can be approved if VILLA KILAVUZU deems it appropriate depending on the capacity of the villa/apartment. VILLA KILAVUZU may request an additional fee from the customer. After entering the villa/apartment, guests other than those specified in the reservation list are absolutely not accepted to the villa/apartment. In cases where the contrary is detected, VILLA KILAVUZU has the right to request the guests to leave the villa/apartment, to cancel the reservation completely or to request the villa/apartment to be completely evacuated without waiting for the end of the rental period, and to request the full fee and an extra fee. During the rental phase of the villa/apartment, the transaction is carried out in accordance with the customer's declaration, and the customer accepts that the information provided is correct and complete, and accepts all responsibilities that may arise in this regard.
VILLA/APARTMENT CLEANING and MAINTENANCE and EXTRA EXPENSES
Weekly, monthly villa/apartment rental prices include entrance cleaning. For stays of 2 (two) weeks and above, weekly cleaning and towel/sheet etc. change are included in the prices. Apart from this, any cleaning and towel/sheet etc. change that is requested is subject to a fee. Pool and garden maintenance is carried out early every morning and if any technical problem occurs in the villa during the rental period, it will be fixed by the host, VILLA KILAVUZU is not responsible for this, it only helps to fix the problem. In order to perform periodic maintenance of the pool, garden and other fixtures of all villas/apartments, the personnel on duty must enter the garden or inside the villa/apartment. In order for these services to run smoothly, the customer must allow the personnel on duty to enter the villa/apartment when necessary. Unless otherwise stated on the villa/apartment detail page on our website, electricity, water, bottled gas, pool lighting, internet connection and air conditioning are included in the prices. Pool lighting, air conditioning and internet may not be available as standard in every villa/apartment, so it is recommended that you carefully read the features of the villa/apartment you rent on our villa/apartment description page.
PET AND SMOKING
Unless otherwise stated, pets are strictly not allowed in our villas/apartments.
Smoking is not allowed in the closed areas of all our villas/apartments.
PRICES
The villa/apartment rental prices stated on our website daily, weekly, monthly. The deposit can be made via bank transfer to our bank accounts, via EFT, or via the Credit Card payment system.
RESERVATION, PAYMENT, CANCELLATION AND REFUND CONDITIONS
The customer may cancel their trip before the trip starts. The customer must notify VILLA KILAVUZU in writing and notifications that are not made in writing cannot be accepted. Reservation cancellations made by talking on the phone are absolutely not valid. Reservation cancellations are valid from the moment VİLLA KILAVUZU receives the written notice.
In case of cancellation, VİLLA KILAVUZU will collect a certain percentage of the total price of the services specified in the travel agreement from the customer in order to compensate for the precautions taken, expenses and the grievances of the villa/apartment owners. These amounts are determined as follows.
CANCELLATION CONDITIONS
If a Prepayment (Deposit) has been Received;
a) The 30% prepayment (deposit) paid for the reservation is absolutely non-refundable.
b) In case of cancellations made 30 days or less prior to your Villa/Apartment check-in date or in case of no arrival at the villa/apartment, the customer will be required to pay 100% of the payment. Must be paid.
If the total payment has been received in full;
a) For cancellations made up to 30 days or more before your Villa/Apartment check-in date, a 30% down payment (deposit) will be calculated and this amount will not be refunded. The remaining amount will be refunded to your account.
b) For cancellations made up to 30 days or less before your Villa/Apartment check-in date or in case of no arrival at the villa/apartment, the payment will not be refunded. In reservation cancellations; Burdens such as material damages, commission fees, etc. that have arisen or will arise due to refunds of payments made by EFT, money transfer or credit card, and that will be charged to Villa KILAVUZU by the Republic of Turkey, its bank or banks, will be deducted from the money to be refunded to the customer.
In case of unilateral cancellation of the villa/apartment reservation by VİLLA KILAVUZU for any reason, this will be notified to the customer as soon as possible. If there is an equivalent villa/apartment available in our portfolio on the same dates, it will be offered to the customer. In cases where the customer does not approve and which are not included in the "force majeure" clause, the money received will be returned to the customer. Villa KILAVUZU is absolutely not responsible and cannot be held responsible for any damages arising from reservations canceled by Villa KILAVUZU. The customer's previously purchased plane ticket, bus ticket, rented car, boat, transfer service etc. also hotel and hostel accommodation fees etc. Villa KILAVUZU is absolutely not responsible for any details it has stated, any permits it has received from a private company or the state being burned, etc., and cannot be held responsible. The customer renting the villa/apartment agrees to take this into consideration.
DAMAGE DEPOSIT
A different amount of damage deposit will be collected from the customer according to the features of each villa/apartment. This deposit amount will be written in the confirmation document sent to the customer during the reservation process. The damage deposit will be collected from the customer in cash against receipt on the day of arrival at the villa/apartment and will be refunded in cash if the villa/apartment and the fixtures of the villa/apartment are delivered in good condition and there is no damage, missing items, etc. before the customer leaves the villa/apartment. If the customer wants to leave the villa/apartment at an earlier time than stated in the contract or if the villa/apartment exit check cannot be carried out due to busy hours, the deposit will be sent to an account number to be received from the customer. If the damage in the Villa/Apartment exceeds the amount of the deposit received, the customer will be asked to pay for this damage, otherwise legal action will be taken.
SWIMMING POOLS
Swimming Pool temperatures of our Villas/Apartments; varies according to weather conditions and seasonal temperatures, the customer renting the villa/apartment cannot hold VILLA KILAVUZU responsible for not being able to enter the pool due to the pool being cold and therefore not being able to use the pool.
HEATED POOLS
The maximum pool temperature in villas with heated pools is 28 degrees. The customer has accepted a maximum temperature of 28 degrees. The customer has undertaken not to request a pool temperature above 28 degrees and has made a reservation accordingly. Villa Kılavuz cannot be held responsible for any problems that may arise from the pool temperature.
OUR RESPONSIBILITIES AND WARRANTY
VILLA KILAVUZU is responsible for the villa/apartment being delivered to the customer on the specified date and time, clean and ready for use. Upon entering the villa/apartment, if there is any broken, non-working item or malfunction, the customer must immediately notify VILLA KILAVUZU and request that these malfunctions be fixed. VILLA KILAVUZU will notify the villa/apartment owner or the relevant company of this request and ensure that this malfunction is fixed within 48 hours at the latest. VILLA KILAVUZU is not responsible for the repair of the malfunction, it helps to fix the malfunction. VILLA KILAVUZU cannot be held responsible for malfunctions that are not reported on time. VILLA KILAVUZU acts as an intermediary between the villa/apartment owner and the customer and therefore the villa/apartment owner is responsible for resolving any problems that may occur in the villa/apartment. Apart from this, VILLA KILAVUZU cannot be held responsible for any accidents, illnesses, injuries, drowning in the pool, death, theft, etc. that may occur and are the responsibility of the customers, and any fire, theft, etc. that may occur in the villa/apartment. Apart from this, VILLA KILAVUZU will definitely not be responsible for any problems that may arise from any services such as trips, shopping, food, drinks, entertainment, transportation, travel, guidance services, etc. that the customer receives from third parties/companies during their arrival at the villa/apartment, their return, and during their holiday. After leaving the villa/apartment, the customer cannot claim any rights or refund for a service that he/she could not receive due to a malfunction or failure that he/she did not notify VILLA KILAVUZU during his/her stay in the villa/apartment.
INVOICE - TAX
No villa or apartment published on the VILLA KILAVUZU web page belongs to VILLA KILAVUZU. The owners of each villa/apartment are different persons, individuals, institutions or companies. VILLA KILAVUZU is an intermediary (broker) for individuals, individuals, institutions, companies to rent their villas/apartments to the customer, therefore VILLA KILAVUZU only issues a brokerage (brokerage) invoice. In other words, it earns a certain brokerage (brokerage) profit from the fee paid by the customer and issues an invoice for this profit. Since the remaining profit is the profit of the villa/apartment owner, it does not issue an invoice for the rest. The villa/apartment owner pays its tax to the state under the name of rental income declaration at the end of the year. VİLLA KILAVUZU is only obliged to issue invoices for the profits it earns, it does not issue invoices for the profits earned by third parties, institutions, individuals or companies, and is absolutely not responsible for this and cannot be held responsible.
RESPONSIBILITIES OF CUSTOMERS
Customers are obliged to use the villa/apartment, pool, garden furniture, all electrical and electronic appliances and other furniture delivered to them in the villa/apartment in a working and sound condition in a clean manner. Customers are obliged to leave all kitchenware delivered to them clean in the same way. On the day of departure, the villa/apartment must be returned with all garbage thrown away and dishes washed. Otherwise, and in cases where the villa/apartment is left dirty beyond reasonable limits, VILLA KILAVUZU will collect a cleaning fee from the damage deposit.
In case of any damage to the villa/apartment, customers are obliged to notify VILLA KILAVUZU. Any damage and any loss caused by customers to the villa/apartment during their stay will be covered by the customer's responsibility. If a damage deposit has been taken, the cost of the item will be deducted from this deposit, and in cases of damage exceeding the damage deposit, the customer will be asked to pay in cash.
In addition, the customer and their companions must be careful to comply with social and moral rules, not to make noise that will disturb the environment, not to listen to loud music, and not to engage in behaviors prohibited by our country's laws and that constitute a crime. For such reasons, if a complaint is received by VILLA KILAVUZU about the customer and their accompanying persons, VILLA KILAVUZU has the right to ask the customer to vacate the villa/apartment before the reservation period expires.
VILLA KILAVUZU does not guarantee the visibility of our customers who will stay in the villas specified on the web page and defined as conservative (villas with pools not visible from the outside). In terms of visibility, customers must ensure their own privacy. VILLA KILAVUZU does not accept responsibility for such problems. VILLA KILAVUZU cannot be held responsible for such problems.
In addition, according to the new law, legal action can be taken against the person/persons staying other than the persons whose identity information is taken and entered into the KBS (Identity Notification System) database during check-in, and that this constitutes a crime according to the law, VILLA KILAVUZU informs the tenant with the agreement it makes during check-in. The customer is responsible for paying any fines that may occur due to incomplete or incorrect identity notification or accommodation without identity information included in the contract. The customer accepts and agrees to these terms when signing this contract.
During the reservation phase of the holiday home, transactions are carried out in accordance with the customer's declaration. The customer accepts and agrees that the information provided is correct and complete. VILLA KILAVUZU is not responsible for problems arising from incomplete or incorrect information provided by the customer.
FORCE MAJEURE
In cases falling within the scope of force majeure, VİLLA KILAVUZU may terminate this agreement unilaterally without incurring any legal liability. War, threat of war, uprising, strikes, natural disasters, fires, terrorist activities, epidemics, technical problems that may occur in transportation in the region or in the country, superstructure and infrastructure works carried out by municipalities or public institutions that VİLLA KILAVUZU cannot prevent, bans imposed by state authorities in the region and all events that are impossible to foresee and develop beyond our control are within the scope of force majeure. will be evaluated.
COMPLAINTS
Customers will immediately report their complaints during their stay in the villa/apartment to VILLA KILAVUZU. The situation in question will be examined by VILLA KILAVUZU staff and the necessary measures will be taken immediately. VILLA KILAVUZU will not be held responsible for any complaints that are not reported during the accommodation, or that are made after the accommodation is over and the villa/apartment is left.
SECURITY AND PRIVACY POLICY
VILLA KILAVUZU will not disclose personal information to any company or third parties except for the cases defined in this Privacy Policy and Terms of Use. VILLA KILAVUZU never sells the personal information of visitors, registered users and partners to third parties. Personal information; refers to any information that identifies the user, such as name and surname, address, telephone number, e-mail address. VİLLA KILAVUZU may use personal information to determine a user profile within its own organization and to conduct statistical studies and may share it with third parties only for the purpose of conducting these studies. VİLLA KILAVUZU shall keep personal information strictly private and confidential, consider this as an obligation of confidentiality, and ensure and maintain confidentiality, prevent all or any part of the confidential information from entering the public domain or unauthorized use or third-party use. undertakes to take the necessary precautions and show the necessary care to prevent disclosure to any person. Although VİLLA KILAVUZU takes the necessary information security measures, VİLLA KILAVUZU will not have any responsibility in the event that confidential information is damaged or passed on to third parties as a result of attacks on the "www.villakilavuzu.com" site and the system. www.villakilavuzu.com may provide links to other sites within the site. www.villakilavuzu.com does not bear any responsibility for the privacy practices and contents of the sites accessed through the link. www.villakilavuzu.com determines the IP addresses of users when necessary and uses them. IP addresses may also be used to identify users in a general manner and to gather broad demographic information.
OTHER IMPORTANT INFORMATION
1) In cases where VILLA KILAGUZU could not prevent the roads leading to the Villa/Apartment being bad, uphill, unstable, wet ground, etc., VILLA KILAGUZU cannot be held responsible in any way.
2) Accidents that may occur during transportation to the Villa/Apartment, etc. in short, any kind of VILLA KILAVUZU cannot be held responsible for any negativity.
3) In the event that the different materials used in the construction of some villas (cedar tree, pine tree, some plastic products, any kind of plant in the garden or inside the villa, etc.) disturb the customer in terms of health or psychology, VILLA KILAVUZU cannot be held responsible for this incident.
4) All customers who will stay in our Villas/Apartments will need a private vehicle. The customer's transportation to the villa/apartment is his/her own responsibility. VILLA KILAVUZU cannot be held responsible in any way.
5) VILLA KILAVUZU cannot be held responsible in any case where the customer who rented the villa or apartment is not satisfied with the geographical location of the villa or apartment they rented. VILLA KILAVUZU has marked the location of the villa/apartment on Google Maps.
6) VILLA KILAVUZU cannot be held responsible for any damage to your private or rented vehicle during transportation to the villa/apartment.
7) The bottom of the vehicle (motorcycle, car, etc.) of the customer who rented the villa/apartment is close to the ground, the engine power of the vehicle is weak, the customer; car, motor, etc. Any negativity that may arise due to inexperience in using the property and not being able to reach the villa/apartment is the responsibility of the customer. VILLA KILAVUZU cannot be held responsible for such or similar problems.
8) The "distance table" specified on the "www.villakilavuzu.com" detail page about the Villa/Apartment is written approximately. The distances are not clearly stated. There may be minor errors. The customer renting the Villa/Apartment agrees to take this into consideration.
9) The "distance table" specified on the "www.villakilavuzu.com" detail page about the Villa/Apartment The distances stated in the description are written by taking into consideration the nearest restaurant, nearest beach, nearest centre, nearest bus station and nearest airport. VİLLA KILAVUZU does not accept responsibility if the specified restaurant or market is closed.
10) VILLA KILAVUZU cannot be held responsible for any accidents such as drowning, falling, broken feet, broken arms that may occur in the pool located in the villa/apartment.
11) All villas have a hot water tank of approximately 160 liters heated by solar energy. The customer is personally responsible for any problems arising from excessive hot water consumption outside of fair use and no hot water left, VILLA KILAVUZU cannot be held responsible for any problems arising from this situation.
12) There is no food, drink, or any food product etc. in any of our villas/apartments. There are no services such as breakfast, lunch, dinner, buffet etc. in a villa/apartment. Providing these products is the customer's own responsibility. VILLA KILAVUZU cannot be held responsible for such situations.
13) VILLA KILAVUZU cannot be held responsible for situations such as no mobile phone signal, little signal or no internet from the mobile phone in the villas/apartments or on the road. You can call your GSM operator and get detailed information about the GSM signal status in the region you will go.
14) By credit card or mail order or EFT or money transfer or etc. Even if you make a payment like this, never buy a plane ticket, bus ticket, etc. before you receive a "confirmation e-mail" and a "confirmation document". Even if you make the payment to VİLLA KILAVUZU, you will not be considered to have rented the villa/apartment if you do not receive a "confirmation e-mail" and a "confirmation document". VILLA KILAVUZU cannot be held responsible for any material or moral damages that may arise from this and similar situations where the customer acts hastily.
15) VILLA KILAVUZU cannot be held responsible for any accidents and incidents that may occur in the Villa/Apartment caused by the customer, such as fire, electrical leakage, gas leakage and deaths and accidents that may occur as a result of these, telephone and internet outages caused by the internet provider (Turk Telekom etc.), power outages caused by the Electricity Company, water outages caused by the Water Company.
16) The Villas/Apartments we have specified on our website are exactly the same and are not the same as they appear on the site. Excuses such as that it is not as advertised, that it looks better on the site, that it is bigger or smaller on the site, etc. are never acceptable and VİLLA KILAVUZU cannot be held responsible for them.
17) VILLA KILAVUZU cannot be held responsible for any negative situations that may arise from positive or negative natural events/conditions and positive or negative weather conditions/conditions.
18) VILLA KILAVUZU cannot be held responsible for any incidents such as bee, scorpion, insect, snake bites, cat, dog bites, etc.
19) Customers who want to prefer conservative villas, which are called villas with pools that are not visible from the outside, can see on the villa's detail page; "this villa is suitable for conservative families", "pool is not visible from the outside", "veiled women can prefer" etc. If there are no such statements, that villa is not a conservative villa. VILLA KILAKULU is definitely not responsible for those who rent a villa without such statements and say "this villa is not a conservative villa" when they arrive at the villa and blame VILLA KILAKULU. We recommend that the customer who will rent the villa reads all the details carefully.
20) Ants or insects etc. inside the villa/apartment or on the pool garden or pool terrace due to any foodstuff or your garbage. or other animals are the sole responsibility of the customer, VILLA KILAVUZU cannot be held responsible for this situation.
21) VILLA KILAVUZU cannot be held responsible for any kind of illness, chlorine allergy, etc. chemical allergy that may occur from the water coming from the swimming pool or shower of the villa/apartment. We recommend that people with health or body sensitivities do not enter the pool.
22) Any kind of large animals, small animals, chickens, partridges, etc. around the rented villa/apartment. animal husbandry is possible, any kind of fertilizer can be used in the garden of the rented villa/apartment or in the gardens of neighboring houses/villas/apartments, VİLLA KILAVUZU is absolutely not responsible for any disturbing animal sounds and bad smells that may arise from these and similar events, and cannot be held responsible.
23) In cases such as funeral, death, war, health problem, accident or cancellation of leave of public personnel or private company personnel, all rental conditions are valid and cancellation is absolutely out of the question.
The customer has accepted all the conditions we have stated above, and this and etc. In case the customer tries to terminate the lease agreement by making excuses, VİLLA KILAVUZU may use its right to terminate the agreement on its own and to demand the contract fee.
DISPUTES
Kaş Enforcement Offices and Courts are authorized for all kinds of disputes that may arise regarding the issues within the scope of this agreement. CUSTOMERS WHO MAKE A RESERVATION FOR ANY OF OUR VILLAS/APARTMENTS ARE CONSIDERED TO HAVE ACCEPTED ALL OF THE ABOVE TERMS. ANY BEHAVIOR CONTRARY TO ANY OF THESE TERMS "VILLA GUIDE" NA GIVES THE RIGHT TO CANCEL THE RESERVATIONS UNIlaterally, NOT TO MAKE A REFUND AND TO REQUEST THE FULL FEE.
